Health and Safety: How will the new Construction (Design and Management) Regulations affect you?

The new 2015 CDM Regulations will have an impact on anyone who is involved with building refurbishment and construction projects including domestic clients.

The new 2015 CDM Regulations will have an impact on anyone who is involved with building refurbishment and construction projects including domestic clients.

For the first time domestic clients will have to take some responsibility for work undertaken at their homes.

We have identified some of the principle issues below.

Notifiable Projects to Health and Safety Executive, F10

  • Work taking more than 30 days and 20 or more persons working at the site on any one occasion; or
  • Work involving more than 500 person days

Duties of Client (business and domestic)

Where more than one contractor is engaged to work on site the client must:

  • Appoint Principal Contractor
  • Notify HSE on Form 10
  • Provide pre-construction phase information
  • Ensure adequate construction phase plan has been written
  • Keep and maintain the Health and Safety File

Duties of Principal Contractor

  • Advise client of their duties
  • Create a construction phase plan and widely circulate
  • Provide suitable risk assessments / method statements
  • Ensure safety standards on site are maintained

Duties of Principal Designer

  • Responsible for all other designers
  • Advise client and aim to design out risk wherever possible
  • Provides information to Principal Contractor related to the design for inclusion in construction phase plan
