CDM Regulations

The Construction (Design and Management) Regulations 2007 require that health and safety is taken into account and managed throughout all stages of a construction project.

The CDM Regulations place responsibilities on the Principal Contractor to take over and develop the Health and Safety Plan during the construction phase, and to include all relevant assessments required by law.

This process begins at conception, continuing through to design, planning, construction, maintenance and subsequent repair of the structure.

It is now a requirement on clients to appoint a competent CDM Co-ordinator whenever a notifiable project is planned.

Scope of CDM regulations

The Regulations apply to all construction, refurbishment and demolition work which is notifiable to the Health and Safety Executive (HSE). All projects that last more than 30 days or 500 days come under these regulations.

Who is affected by CDM regulations?

CDM affects everyone who takes part in the construction process, including the client, designers and contractors. The regulations introduce four key roles:

  • The CDM Co-ordinator;
  • The Principal Contractor;
  • The Client;
  • The Designer.

The Regulations also require a Health and Safety Plan Health and Safety file to be produced at the correct stage.

What does CDM require?

All persons involved with CDM have specific roles to play in achieving a safe work site and minimisation of risk. What each duty holder undertakes will vary from project to project. The effort everyone makes should be proportional to the health and safety risks associated with the work and the difficulty of managing those risks.

This means that for small, easily managed low risk projects very little is required. If the project is complex and the risks are high, much more effort is needed.
